1. No Legal Advice: The AI Act Twin is an initial orientation tool. Risk classifications, digital-twin models, compliance scores and AI-generated responses constitute a technical and regulatory analysis based on automated algorithms and third-party AI systems (Anthropic Claude API). They do not constitute individual legal advice within the meaning of the German RDG.
2. No Attorney-Client Relationship: Use of this tool does not establish an attorney-client relationship with Rechtsanwalt Theo Funk. A binding engagement (Art. 22 AI Act representation, Gap Report, AI Compliance Officer) requires a separate written agreement (Step 2).
3. Limitation of Liability: Liability for the accuracy, completeness or legal correctness of Step 1 results is limited to intent and gross negligence. Ordinary negligence excluded except injury to life, body or health (§ 309 Nr. 7 BGB). The AI Act is subject to delegated acts, Commission guidelines, implementing regulations, the GPAI Code of Practice and harmonised standards — this tool reflects a point-in-time snapshot.
4. Transition to Legal Review (Step 2): For legally binding assurance — gap-analysis report, Art. 22 AI Act representation, or engagement as external AI Compliance Officer — a personal assessment by Theo Funk, Rechtsanwalt (Rechtsanwaltskammer Bamberg), is mandatory.
5. Data Processing & AI Disclosure: The AI Assistant transmits user inputs to the Anthropic API (Anthropic PBC, San Francisco, USA). No personal data is required. No conversation data is stored. See: kanzlei-theofunk.de/datenschutz.
